These Terms of Service ("Terms") govern your use of the eazco.com website and the purchase of products from EAZCO ("we," "us," or "our"). By accessing the website or placing an order, you agree to these Terms.
1. Orders and Acceptance
All orders are subject to acceptance by EAZCO. We reserve the right to refuse any order at our sole discretion. An order is confirmed when we issue a written confirmation by email.
2. Pricing and Payment
Prices listed on the website and in quotes are in U.S. dollars and exclude shipping, freight and applicable taxes. Pricing is subject to change without notice. Payment is due in full prior to production for new customers; established customers may qualify for net-30 terms.
3. Custom and Imprinted Orders
You are responsible for reviewing and approving the digital proof we provide before custom production begins. Once you approve a proof, EAZCO is not responsible for errors in the approved artwork, including misspellings, color variations within accepted tolerances, or omissions.
4. Cancellation
Stock orders may be cancelled without penalty before they ship. Custom and Deluxe orders may be cancelled before production begins; once production has started, cancellation is at our discretion and may incur charges for work completed and materials consumed.
5. Shipping and Risk of Loss
Title and risk of loss pass to you upon delivery of the products to the shipping carrier. Delivery dates are estimates only. EAZCO is not liable for carrier delays.
6. Limited Warranty
EAZCO warrants its products to be free from manufacturing defects for sixty (60) days from delivery. Our sole obligation under this warranty is to replace defective units. This warranty does not cover damage from misuse, accident, or normal wear.
7. Limitation of Liability
To the maximum extent permitted by law, EAZCO's liability for any claim related to a purchase is limited to the amount you paid for the affected products. We are not liable for indirect, incidental, consequential or punitive damages.
8. Intellectual Property
All website content, including text, graphics, logos and images, is the property of EAZCO and is protected by United States copyright and trademark law. Artwork you submit for custom orders remains your property; you grant us a limited license to reproduce it solely to fulfill your order.
9. Governing Law
These Terms are governed by the laws of the State of Louisiana, without regard to its conflict of laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Orleans Parish, Louisiana.
